Applicable legislation and regulations stipulate that Distribution Network Operators must be legally independent from the organization and decision-making of other activities in the electricity sector, such as electricity transmission, production and marketing.
E-REDES is legally required to have an annual Compliance Programme that sets out the rules and procedures to be followed to ensure its independence – in particular to ensure that there is no discriminatory behaviour in its interaction with different entities.
The preparation and monitoring of compliance with the E-REDES Compliance Programme is the responsibility of its Independent Compliance Officer, in accordance with the law. In this context, E-REDES has appointed Dr Margarida Rosado da Fonseca, who has access to all the information necessary to perform her duties.
Annually, Dr Margarida Rosado da Fonseca shall submit a compliance report to ERSE with her conclusions regarding compliance with the E-REDES Compliance Program for the previous year.
E-REDES is also legally required to have a Code of Conduct relating to the functional independence of its network operation, with a set of rules of conduct to be followed by its employees and service providers.
The E-REDES Code of Conduct includes:
- The Regulation for the Treatment of Commercially Sensitive Information and Commercially Advantageous Information;
- The List of Commercially Sensitive Information;
- The Questionnaire on Commercially Advantageous Information;
- The Procedures for Servicing E-REDES Customers;
